1. It is Mandatory, Not Optional (Imperatividad)
Since June 1, 2013, it is legally mandatory to have an Energy Performance Certificate (EPC) —Certificado de Eficiencia Energética (CEE)— to sell or rent any property in Spain. This requirement is necessary to formalize the sale before a notary.
2. Penalties for Non-Compliance
Not having the certificate, or having an expired one, can result in fines ranging from €300 to €6,000.
3. "No-Go" Areas for 2030/2033
Future regulations aim to ban the sale or rental of energy-inefficient homes. By 2030, homes must have at least an "E" rating, and by 2033, a "D" rating. Currently, over 80% of Spanish homes are rated E, F, or G.
4. Validity: 10 Years or Less
  • The certificate is generally valid for 10 years.
  • Exception: If the property has a "G" rating (the lowest), it is only valid for 5 years.
5. Even if it is a "G," you can sell

6. Who Pays?
The owner (seller) is responsible for paying for and obtaining the certificate, not the buyer.
7. Advertising Requirement
It is mandatory to include the energy rating (the letter A-G) in any advertisement for the sale or rental of the property.
8. Exemptions
Not all buildings need one. Exemptions include buildings with a total useful area of less than 50 square meters, isolated, or buildings used for less than 4 months a year.
